The Problem: Your opposing party claims their Coinbase account has a zero balance. You know they bought $500k in Bitcoin in 2021. Where did it go?

The Reality: They likely moved the assets to a “Self-Custody” cold wallet (Ledger, Trezor, or Metamask). These wallets do not respond to subpoenas. However, the bridge to get there leaves a permanent artifact.

What We Look For in Discovery

We analyze the laptop and mobile backups to find the “keys” to the castle:

  • BIP39 Seed Phrases: We scan “Notes” apps and photo libraries for the 12-24 word recovery phrases that grant immediate access to the funds.
  • Ledger Live Logs: Even if the USB device is missing, the computer retains the “xPub” (Extended Public Key), allowing us to view the entire transaction history and current balance of the hidden wallet.

Pattern of Life Analysis

We correlate system logs from iPads, gaming consoles (Steam/Xbox), and mobile devices to create a minute-by-minute timeline of the parent’s attention.

  • The “Homework” Alibi: If the parent claims they were tutoring the child at 6:00 PM, but their Steam account logs show an active multi-player session from 5:30 PM to 8:00 PM, their affidavit is impeachable.
  • Unsupervised Internet Access: We extract Safari/Chrome history from the child’s iPad during the opposing party’s custodial time to evidence exposure to age-inappropriate content.
  • Sleep Deprivation: System logs revealing device usage at 2:00 AM on school nights while in the opposing party’s care.

Family Litigation Lab (“the Firm”) operates under strict Chain of Custody protocols compatible with Federal Rules of Evidence. We recognize that our clients—and the ultimate beneficial owners of the data we analyze—are involved in active litigation.

1. Information Handling

Unlike commercial data processors, we do not monetize, share, or aggregate client data. All forensic images are stored in air-gapped, encrypted cold storage. Data is retained strictly for the duration of the litigation hold or as mandated by court order.

2. Attorney Work-Product

All communications and findings are treated as Attorney Work-Product until designated otherwise by retaining counsel. We maintain a strict conflicts check database to ensure we never engage with opposing parties.

3. Security Standards

We utilize AES-256 encryption for all data at rest and TLS 1.3 for data in transit. Access is restricted to authorized forensic examiners on a need-to-know basis.
